Definition of Terms
Porter Quality Improvement LLC is the data controller, and we are responsible for your personal data (referred to as “PorterQI,” “we,” “us” or “our” in these terms).
Users and members of the site (referred to as “you” and “your”)
PorterQI Community Guidelines
Thank you for being part of the PorterQI Community. To ensure the best possible experience for all members, we have established some basic guidelines for participation.
By joining and using this community, you agree that you have read and will follow these rules and guidelines. You also agree to reserve discussions, shared files, and content to that best suited to the medium. This is a great medium with which to solicit the advice of your peers, benefit from their experience, and participate in ongoing topical conversations. Please take a moment to acquaint yourself with these important guidelines. If you have questions, contact the member services department at support@porterqi.com. In order to preserve a climate that encourages both civil and fruitful dialogue, we reserve the right to suspend or terminate activity in this community for anyone who violates these rules or any time we believe it to be in the best interests of PorterQI.
The rules
- Don’t challenge or attack others. The discussions and comments are meant to stimulate conversations not to create contention. Let others have their say, just as you may.
- Do not use the site the site solely to advertise commercial products or services. Do not solicit users on the main feed, others’ profiles, forums, groups, or in any other unsolicited manner that may be perceived as aggressive. This is a community for professionals, so a certain amount of professional posting is expected. If you have goods and services that might help other members of the community, create a group and forum and discuss your business off the main feed.
- Information posted to the site outside of private groups is publicly available for all to see, and comments are subject to libel, slander, and antitrust laws. Use caution when discussing products, people, and organizations.
- Information posted to private groups is not publicly available, but must still abide within the bounds of the law. Abide by HIPAA standards even in private groups.
- All defamatory, abusive, profane, threatening offensive, or illegal materials are strictly prohibited. Do not post anything that you would not want the world to see or that you would not want anyone to know came from you.
- Don’t disclose confidential information without authorization. Abide by HIPAA laws even in private groups.
- Only post content that you have the right to use. Don’t post anything that may violate someone else’s copyrights, trademark rights or other proprietary rights. By posting material, the posting party warrants and represents that he or she owns the copyright with respect to such material or has received permission from the copyright owner.
- Your postings will not be considered or treated as confidential. By posting, you hereby grant PorterQI and users of this site the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use such information or other material.
- Don’t communicate in a manner or for a purpose that could violate federal or state antitrust laws. Messages should not be posted if they encourage or facilitate members to arrive at any agreement that either expressly or implicitly leads to price fixing, a boycott of another’s business, or other conduct intended to illegally restrict free trade. For example do not use the community to communicate with competitors about prices, discounts, market shares, sales territories, or selection or rejection of customers or suppliers, or other terms or conditions of sale.
- Post your message or documents only to the most appropriate lists or libraries. Do not spam several lists or libraries with the same message. All messages must add to the body of knowledge. We reserve the right to reject or remove any message for any reason.
Shared Resources
PorterQI members may request that materials including health policies, reference guides, and publications be posted in the groups and forums of the PorterQI Community. Files made available in this area are provided by members and have not been reviewed by PorterQI. PorterQI expressly disclaims any and all responsibility or liability for the use or misuse of any information presented and makes no warranty or representation that such information is accurate, valid, or complete
By submitting materials to PorterQI for posting, a member acknowledges and represents that he/she has authority or permission to reproduce and distribute the information provided for posting, and such member thereby indemnifies PorterQI against any claims that the posting harms or otherwise infringes the rights of another person or organization.
The listing of materials does not constitute and should not be presented or referenced in such a way that would imply endorsement or approval by PorterQI. Items may be removed without notification. PorterQI further reserves the right to remove any materials deemed not in the best interest of the company.
Legal information regarding submissions
This site is provided as a service for the members of the PorterQI Community. PorterQI is not responsible for the opinions and information posted on this site by others. PorterQI does not endorse, approve, recommend, or certify any information, process, method, product, service or organization presented or mentioned on this site, and information from the site should not be referenced in any way to imply such approval or endorsement. Submissions may not be relied on as professional opinions or advice.
Submissions are not intended to constitute medical or legal guidelines or to replace individual judgment with respect to particular situations. Do not assume that the most recent or up-to-date information is included here.
PorterQI does not represent or warrant that the site or its contents are appropriate or available for use in locations other than the United States. Neither PorterQI nor its officers, directors, staff, agents, or representatives shall be responsible for any loss or damage of any kind (including special, indirect, incidental, exemplary, or consequential damages) arising from or in any way relating to (i) the use of or inability to use the site, (ii) any use of the site or reliance by the user on any information or content contained therein, (iii) errors in or omissions from site content, (iv) any third-party web sites or content accessed through links in any site content, or (v) the unavailability of the site.
PorterQI does not actively monitor the site for inappropriate postings and does not on its own undertake editorial control of postings. However, in the event that any inappropriate posting is brought to the attention of PorterQI, we will take all appropriate action, including but not limited to removing any posting and/or terminating access to any user who does not abide by these guidelines.
Representations By Users; Indemnification
As a user, you are solely responsible for the contents of your submissions to the site. You represent that you have all rights necessary to post the information, content or materials submitted to the site without violating the copyrights or any other intellectual property rights of others. You hereby indemnify and agree to hold harmless PorterQI and its officers, directors, staff, agents, and representatives fro many and all claims asserted against them and any liability, loss, damage, costs, or expenses (including reasonable attorneys’ fees) incurred or suffered by them in connection with or arising out of your submissions to the site.
DMCA Notice & Takedown Procedures
PorterQI abides by the federal Digital Millennium Copyright Act (DMCA) by responding to notices of alleged infringement that comply with the DMCA and other applicable laws. As part of our response, we may remove or disable access to material residing on a site that is controlled or operated by PorterQI (such as porterqi.com and any of its sub-domains) that is claimed to be infringing, in which case we will make a good-faith attempt to contact the person who submitted the affected material so that they may make a counter notification, also in accordance with the DMCA.
Notice of Infringing Material
To file a notice of infringing material on a site owned or controlled by PorterQI (such as porterqi.com and any of its sub-domains), please provide a notification containing the following details:
- Reasonably sufficient details to enable us to identify the work claimed to be infringed or, if multiple works are claimed to be infringed, a representative list of such works (for example: title, author, any registration or tracking number, URL);
- Reasonably sufficient detail to enable us to identify and locate the material that is claimed to be infringing (for example a link to the page that contains the material);
- Your contact information so that we can contact you (for example, your address, telephone number, email address);
- A statement that you have a good faith belief that the use of the material identified in (2) is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of the exclusive right that is alleged to be infringed.
- Your physical or electronic signature.

Please note that you may be liable for damages, including court costs and attorneys’ fees, if you submit a notice and you materially misrepresent that content on the site is infringing.
Counter-Notification
If material that you have posted to a site controlled or operated by PorterQI (such as porterqi.com and any of its sub-domains) has been taken down, you may file a counter-notification that contains the following details:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material in question;
- Your name, address and telephone number;
- A statement that you consent to the jurisdiction of the Federal District Court for judicial district in which your address is located or, if your address is outside of the USA, for any judicial district in which Creative Commons may be found and that you wll accept service of process from the person who submitted a notice in compliance with the section (c)(1)(C) of the DMCA, as generally described above;
- Your physical or electronic signature.
